Planning for your family’s future after you are gone is an important task. Approximately 60% of Australians do not have a Will, or the one they do have is out of date.
Dying without a Will means you have no say in how your assets are distributed after your death – this is decided in accordance with legislation in the relevant jurisdiction.
Further, a Will that has been incorrectly prepared may not be legally valid, creating more problems than solutions for your loved ones. Preparing a legally binding Will enables you to decide what happens to your assets when you are gone and will save your family not only stress but time and money during what will undoubtedly be a difficult period for them.
Making a comprehensive estate plan goes beyond preparing a Will. It is important you make plans for management of your affairs if you were to lose capacity, by putting in place an Enduring Power of Attorney and an Appointment of Enduring Guardian. Doing so enables someone of your choosing to act in your best interests to take care of your affairs when you are unable to do so.
Estate administration
We assist in the administration of estates once a loved one has passed away.
We help executors, or next of kin, determine whether a grant of probate is required, and then assist in preparing the application. If your loved one did not leave a Will, then they died ‘intestate’. A different type of application is required to manage their affairs in this case, which is known as Letters of Administration.
Our team will guide you through the process of winding up the affairs of your loved ones to ensure that their final wishes are carried out in an expedient manner.
Challenging or Defending a Will
Our team is well able to assist you if you feel you have not adequately provided for in a Will. We can also assist you if you are an executor who is facing a challenge to a will by a third party.
